BagLimit Terms of Use and Disclaimer

Version 1.2 · Effective 31 October 2026

These Terms are an agreement between you and Thomas Maslauskas, of Gibsons, British Columbia ("we", "us"). They cover your use of the BagLimit app ("BagLimit"). By ticking the box and tapping "Agree and continue", you accept these Terms. If you don't agree, don't use BagLimit.

The same text is also at https://baglimit.app/terms.

1. BagLimit is a guide, not the law

BagLimit gives a plain-language summary of recreational fishing rules for British Columbia, compiled from public federal and provincial sources. It is an independent app. It is not an official or legal source of fishing regulations, and it is not affiliated with, endorsed by, or sponsored by Fisheries and Oceans Canada (DFO), the Province of British Columbia, or any other government body. Government names are used only to identify where the information comes from.

The official regulations, licence conditions, fishery notices and closures are the only legal authority. Even the government's own summaries say this: the BC Freshwater Fishing Regulations Synopsis is "for general information purposes only", and where it differs from the Regulations, "the Regulations are the final authority." If BagLimit differs from an official source, the official source governs.

2. Your responsibilities

You are responsible for:

Before you fish, check the official sources, including DFO (tidal waters and salmon) and the Province of BC (non-tidal freshwater).

3. Offline data may be out of date

BagLimit stores regulation data on your device so it works without a signal. That data is only as current as your last update, and we may not learn of a change right away. Regulations can change at short notice, including during the season. BagLimit shows the date of your data. Treat older data with extra caution and update it whenever you can.

4. Location, maps and boundaries

Location features rely on your device's GPS and on boundary data we have drawn from public sources. GPS can be off by tens of metres or more, especially near shore, in canyons, under tree cover or on the water. Our boundary lines are approximations, not legal surveys. Near any boundary, closure line or river mouth, assume the stricter rule applies until you have confirmed your position and the rule from official sources.

5. Safety; not for navigation

Fishing and boating carry real risks, including drowning, hypothermia, changing weather, tides and currents. BagLimit is not a navigation aid, chart, tide table or safety device, and you must not use it for navigation. Use official charts, tide tables, marine forecasts, proper safety gear and your own judgment.

6. No warranty

To the extent the law allows, BagLimit is provided "as is" and "as available". We don't promise that BagLimit or its data is accurate, complete, current, available, or error-free, or that it is right for your exact location or situation. Nothing we say outside these Terms creates a warranty. Section 9 explains which rights this doesn't affect.

7. Limitation of liability

To the extent the law allows:

This section applies whether a claim is in contract, negligence or any other legal theory.

8. Indemnity

If someone else brings a claim against us because you broke the law or these Terms while using BagLimit, you agree to cover our reasonable costs and losses from that claim. This doesn't apply to the extent the claim was caused by our own fault.

9. Rights these Terms don't take away

Nothing in these Terms limits or excludes:

If a court finds any part of these Terms unenforceable, that part is limited only as far as needed and the rest still applies.

10. Our sources and other services

BagLimit uses information published by DFO and the Province of British Columbia under their licences and attribution terms. The source for a rule is shown with that rule in the app. Those bodies have not reviewed or approved BagLimit. We are not responsible for outside websites we link to.

11. Licence to use the app

We give you a personal, non-transferable, revocable licence to use BagLimit for your own non-commercial fishing. Don't copy, scrape, resell or redistribute BagLimit's compiled data, and don't reverse-engineer the app except where the law allows.

12. Changes to these Terms

We may update these Terms. Each version has a number and an effective date, shown on the Packs tab under Terms of Use and Disclaimer and at https://baglimit.app/terms, and we keep past versions. If we make a material change, we will show it in the app and ask you to accept it before you continue. Other changes take effect when posted. If you don't accept a change, stop using BagLimit. The version you accepted governs anything that happened before the change.

13. Governing law and disputes

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. You may bring a claim in the courts of British Columbia or, if the law where you live gives you that right, in your local courts. These Terms do not require arbitration and do not waive your right to take part in a class proceeding. Please contact us first so we can try to resolve the issue.

14. App stores

These Terms are between you and us, not Apple or Google. We, not Apple or Google, are responsible for BagLimit and its content.

If you downloaded BagLimit from Apple's App Store, you and we acknowledge the following. Your licence does not conflict with the Apple Media Services Terms and Conditions.

15. General

These Terms, our Privacy Policy at https://baglimit.app/privacy, and the in-app disclaimer are the whole agreement between us about BagLimit. Not enforcing a right straight away doesn't waive it. We may transfer these Terms to a successor owner of BagLimit, with notice, without reducing your rights. Sections 1 to 9 and 13 survive after you stop using BagLimit.
